Terms of Service - Golemtek

1. Acceptance of Terms

By accessing or using Golemtek ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service.

2. Description of Service

Golemtek is a web-based campaign management tool designed for tabletop roleplaying game masters. The Service allows users to create, organize, and manage campaign content including NPCs, locations, plot threads, session notes, and other world-building elements. The Service also provides real-time collaboration features for users working together on campaigns.

3. User Accounts

3.1 Registration

To use Golemtek, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to notify us immediately of any unauthorized access to or use of your account. We are not responsible for any losses arising from unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old to use Golemtek. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Content Ownership

4.1 Your Content

You retain full ownership of all campaign content you create using Golemtek, including but not limited to: campaign settings, NPCs, locations, plot threads, session notes, uploaded images, and any other creative content ("User Content"). We claim no intellectual property rights over your User Content.

4.2 License to Us

By using Golemtek, you grant us a limited, non-exclusive license to host, store, backup, and display your User Content solely for the purpose of providing the Service to you and other users you choose to share with (e.g., campaign collaborators).

4.3 Our Content

The Golemtek application, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works from the Service except as expressly authorized.

5. Acceptable Use

You agree not to use Golemtek to:

Violate any applicable laws or regulations
Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Infringe upon the intellectual property rights of others
Attempt to gain unauthorized access to other users' accounts or data
Interfere with or disrupt the Service or servers
Use automated means (bots, scrapers) to access the Service without permission
Upload malware, viruses, or other harmful code
Impersonate any person or entity
Use the Service for any commercial purpose without our consent

6. Service Availability

6.1 No Guarantees

Golemtek is currently in beta. We do not guarantee any specific level of availability, uptime, or performance. The Service is provided "as is" and "as available" without warranties of any kind.

6.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

6.3 Data Backups

While we maintain regular backups of user data, we recommend that you periodically export your campaign content using the built-in export features (Markdown, PDF). We are not responsible for any loss of data.

7. Account Termination

7.1 By You

You may delete your account at any time. Upon deletion, your User Content will be removed from our active systems within 30 days.

7.2 By Us

We may suspend or terminate your account if you:

Violate these Terms of Service
Engage in conduct that is harmful to other users or the Service
Fail to respond to account security concerns
Use the Service in a manner that creates legal liability for us

We will provide notice before termination when reasonably possible.

8. Limitation of Liability

To the maximum extent permitted by law, Golemtek and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us, if any, in the twelve (12) months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless Golemtek and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

10. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or other representative proceeding.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
